Thread: Theft by a member

    Default Theft by a member

I need help from anyone who knows McReef (Mark Lane from New Braunfels). Back in Apr 08 I purchased a monitor from him which he said was new but had a bad spot on the screen and missing parts (USB cable). I told him no biggie because it was a good price but when it broke in Sep 08 I needed help. Dell had no record of him or the purchase, he told me he got it through work so he would have to warranty it through there. Sounded real fishy to me but hey it was getting repaired so I mailed it to him. He confirmed he got it, replied to a couple emails about and ETA then he just quit. He no longer replies to any emails or PM's. Family has advised me to go to small claims court and I have a lawyer who has the paperwork drawn up but it is a lot of BS for under $300.
Anyone who knows him/can help me with this would be great.

wow that's not like Mark! I have dealt with him on several occasions and he has even just flat out given me things. He's a plumber, so it's not like the 300 was for a scam or anything... Have your lawyer find out where he is, and have him served if he does not reply to certified mail. Very strange... Then again, I had a member steal a frag of coral that I refused to sell, so anything is possible.

For small claims court, there's no need for a lawyer. NONE.

A plumber? Really? He talked like he was in tech and traveled out of town constantly for days/week at a time. I think he had good intentions and other than slow responses (due to traveling he said) was very happy with how things were going. But....
That is the route I guess I will try if this doesn't help.

I Know but we have one who has a certified letter drawn up for me to let him know what is going down next. PITA is you have to go to court where he is from not where I live, long drive back and forth several times. I guess expenses could be added into the claim.

I have his full name, address, phone # etc. but it doesn't do me any good unless I want to have a confrontation or be ignored.

I did. What would I need to pursue it that way? All this took place months ago so I do not have anything from the PO.

Not yet, I thought about taking a drive over there and seeing if they would take/go with me to his house to visit but not sure if it would do any good.
