    Default A cautionary tale about DMCA

    A consulting company alledgedly managed to erase their client's (an online retailer) information from Google's search engine:

    Google should go after the company that write those lose type of strings for search engine spamming.

    This is just wrong. About as crazy as the RIAA stuff, and Sony with their rootkits. It all seems to be getting out of control.

    This my friends is business 101 and you had better get used to it. Company 1 asked company 2 to help expand their internet visability. Company 2 says yes we can do that but since it is not easy, we want a piece of the pie if we do such a good job that our work keeps you in the top twenty per cent of searches. Company 1 says great and where do we sign to get this great service. Company 2 says right here and read the mouse print as we will cover our you know what with the mouse print at the bottom. Company 1 says yea great, and signed. Now some time later, they find that what they signed is costing them lots of money and Christmas wasn't as good as they wanted, so they tell company 2 that they won't keep their word and not pay. BUT, company 2 has their signature on the contract and they have kept their word and worked very hard to keep company 1 in the top 20% so they cry foul and the powers that be agree with them.
    Moral of this fine tale is like your daddy always told you , "read and reread the mouse print as that is what bites you in the end if you don't want to keep up your end of the bargain".

    Apparently in the fine writing the consulting company put in as long as their client (BigAls) was in the top 20% of search returns of I think it was three major search engines they were basically to recieve royalties from the company.

    This is where the strange part comes in because from what I understand they copywrited certain search phrases like those above to make sure when they are put in they would link to BigAls (automatically putting him in the top 20). Why I consider this strange was that I was at the understanding that standard descriptions, or phrases that are generally descriptive in nature were not legally able to be copywrited.
