    Both AIG and Progressive are members of IA (Intercompany Arb)...

    Did they put the denial in writing? I would call AIG and find out why they are denying the claim. Even if they say your wife was speeding, she would be comparatively negligent only, with the majority of the liabillity resting with the backing party. He backed into the side of you guys, making him at fault.

    if backing up party knows the victim was speeding then the backing up party knows that this car was going to be behind him if he kept backing up. with that why did he keep going. he could have stopped to avoid an accident. backing up party was being negligent for not yielding to the right of way. thats how i see it.

    First of all I can not believe you are having this much trouble with your insuarance company. Turn it over to them and let them handle it. Personel experience, my wife was backing up at work, a young lady pulled up behind her knowing my wife was backing out of her spot and it was still considered my wifes fault and my insuarance paid the claim, plus her rental car which was more than the damage claim! Looking at the damage of your car I would say the person backing up was speeding?

    They said based on the damage to her car they think she was speeding. LOL these guys are crooks!

    My insurance company has been great, just that I'm too cheap to have rental car coverage on my policy so I'm out of pocket on that. Progressive is handling the repairs and will be attempting to get reimbursement for their costs and my deductible and rental car. If I can get most of both of those back I'm happy.

    I am on my 15th car. What I have found is that instead of fighting for you your insurance will probably drop the claim. This has been my experience with several different companies, even with a police report.

    Well I figured I'd give yall an update. Wife got her car back a couple days ago, somewhere along the line AIG either lost their patootie in arbitration or just decided to give in but either way they paid 100% of everything including the rental car which was nice because we don't carry rental coverage with our own insurance company. Strange they went from claiming 0% liability to 100% at the drop of a hat.

    Seems to me unless an AIG agent was standing there with a radar gun when your wife sped by their client and forced him to back into her they really had no case.

    Then again I'm just a little ole DBA that doesn't make $225 an hour. I'm sure in the wrong business.

    and it doesnt matter that your wife was speeding as long the police report doesn't say it

    i would lawyer up .Insurance companys tend to not want to pay if you dont
